What needs to be deposited
Documents designated for legal deposit are specified in Article 4 of Law 106/2004. The deposit requirement applies to documents or editorial products of cultural interest intended for public use, whether paid or free of charge (offered for sale or otherwise distributed), contained on any analog or digital medium, audio and video documents, photographic documents, artist videos, microforms, etc.
The law provides for the preservation of books, pamphlets, periodicals, geographical and topographical maps, atlases, posters, and printed music in the archives of the Cuneo Civic Library.
Documents not subject to legal deposit (art. 8 – Presidential Decree 252/2006): extracts, proofs, registers and forms, land registry maps, ordinary and detailed advertising material for trade, unaltered reprints, documents for internal or private use.
Partial exemption (art. 9 – Presidential Decree 252/2006): a partial exemption is provided for rare and particularly valuable publications.
Who is required to deposit?
The publications and, specifically, the printed materials and documents similar to them are sent to the depository institutions by the publisher, or in any case by the person responsible for the publication, or by the printer, in the absence of the publisher.
Sanctions (Art. 3 Law 106/2004)
Please note the administrative fines for anyone who violates the law and regulations: the fine is equal to three times the commercial value of the document, doubled in the event of repeat violations, up to a maximum of €1,500.00 for each document not filed; it is increased up to fifteen times in the event of total evasion by the obligated party.
